The Montana Supreme Court Fails Again
Kids in Montana will pay the price...again
The unanimous decision of the Montana Supreme Court to agree with the ruling of a lower district court that SB 99 violates the state’s constitutional right to privacy was a further blow to the protection of Montana youth and parental rights. The temporary block of the enforcement of the 2023 law which bans puberty blockers, cross-sex hormones and surgical mutilation for minors will continue until the case is heard before District Court Judge Jason Marks in Missoula.
This decision comes as it looks likely that the U.S. Supreme Court will uphold Tennessee’s ban on puberty blockers, hormones, and surgery for transgender minors and the U.K. just placed an indefinite ban on puberty blockers for children with gender dysphoria due to unacceptable safety risks. Sweden, Norway and Finland are also sounding the alarm about the potential negative impacts that gender modification is having on youth.
Montana Medical Freedom Alliance is passionate about protecting minors from idealogue activists in healthcare and, sadly, our public education. We believe that there is insubstantial evidence to prove that gender modification improves the mental health of gender distressed minors and may actually cause irreparable harm. We hold firm that God created male and female in His image, does not make mistakes and gives each individual inherent value and dignity (Genesis 1:27). Children are to be protected and not handed over to the recent cult of gender warriors.
We are currently working with legislators to introduce a bill that would do three things:
an extended statute of limitations for individuals who have undergone “gender-affirming care” as minors to sue in medical malpractice
insurance reciprocity for gender transition and detransition service (if an insurance company pays for transition, they must also pay for detransition)
protect mental-health services to help a minor address gender distress
We know that there are many legislators who support this protection of minors so we are looking forward to working with them. We also know that many of YOU see this attack on our kids and want to do something to fight back.

Lastly, the decision from our Supreme Court this week reiterates the importance of electing good judges. We have an overwhelming conservative electorate in Montana but when activist liberal judges overturn our bills that were enacted into law by our elected officials, it’s a problem. We need to be laser-focused on the election of each judge and work towards partisan judicial elections.
